According to an August 2012 survey of 1,015 American adults, virtually all (96 percent) say it is important to them to know that the restaurants they visit train employees in food safety. But the NFLPA hasn?t ruled out doing so.

NFLPA executive director DeMaurice Smith, in an extensive interview with SI.com, was asked about the possibility that players will withhold services due to concerns regarding safety risks associated with the replacement officials.

?In America it is the employer?s obligation to provide as safe a working environment as possible,? Smith told Jim Trotter of SI.com.? ?We believe that if the National Football League fails in that obligation we reserve the right to seek any relief that we believe is appropriate.? The NFL has chosen to prevent the very officials that they have trained, championed and cultivated for decades to be on the field to protect players and ? by their own admission ? further our goal of enhanced safety.? That is absurd on its face.?

To some, the possibility of a player strike may seem absurd on its face.? We explained last month that it could happen, despite the presence of a no strike/no lockout provision in the CBA.? Still, if the players wouldn?t risk a paycheck in order to get a better overall deal with the owners in 2011, they won?t risk paychecks over safety concerns that, based on their chronic resistance to rules changes and fines/suspensions levied by the league office, don?t concern them.

Still, the NFLPA can do other things, from making the case for the lockout to end to filing a grievance or other legal action aimed at forcing the league to allow the locked-out officials to return to work.? It sounds like something tangible could be coming.

?We?ve been very public in saying that we believe on a scale of 1-10 the use of replacement referees in the preseason is a 12,? Smith said.? ?That goes up to a 16 now that you?re entering into the regular season.?

Smith identified three ?fundamental facts that are inescapable? in support of his views:? ?One, the players and the league have made tremendous strides in trying to make the game safer over the last three years. The second fact is, at the players? urging, the National Football League last year gave the referees more power to spot and deal with a concussed or injured player. The third inescapable fact is, over the last 20 years the league has done everything to maintain an experienced referee corps.?

He pointed out that, typically, rookie officials are introduced only with a team of experienced officials., and that the locked-out officials have nearly 1,500 years of experience.? So why would the NFL use entire teams of rookie officials?? ?The only conclusion that I have,? Smith said, ?is that the league cares more about money than it does about the experience of the referees as a vehicle to increase player safety.?

Smith also called upon owners to be involved in the process.

?The owners have invested in the players, and each and every owner loves what keeps the National Football League unique among sports.? And it?s two things, on any given Sunday a team could win; and every game matters,? Smith said.? ?So my question to the owners is, because those two things are true, why would they ever want to leave the game in critical moments in the hands of referees that they ordinarily would never hire?? I mean, If these referees were so credible, how come they hadn?t hired them before the lockout??

We?ve disagreed with Smith at certain times in the past.? It?s very hard to disagree with him on this point.

Using new officials creates a risk of errors that will affect the outcomes of games.? With the margin between making the playoffs and not making the playoffs at times razor thin and with recent history showing us that any team that gets in to the postseason can run the table, a bad, game-altering call in Week One could, in a roundabout way, have an effect on the outcome of the season.

The two sides simply don?t seem to be far enough apart to justify that risk.? The problem is that there?s no one who can clunk the parties? heads together, Moe Howard-style, and force them to find a middle ground.

Until that happens, the two sides will continue to line up like the boys and the girls on opposite walls at the junior high dance, waiting for each other to make the first move.

China?s government revenue is maintaining a relatively high growth speed despite a slowdown in the economy, with non-tax collections becoming the main driver of the expansion.

Among the 21 provinces that have published their fiscal data in the first four months this year, 17 have reported government income growing faster than 10 percent, with Tianjin leading the table at a growth rate of 27.3 percent.

According to the Ministry of Finance, the national fiscal income increased 12.5 percent in the first four months this year, when gross domestic product growth slowed to 8.1 percent in the first quarter.

The fiscal income growth rate was 18.9 percentage points less than that of the previous year, mainly because of retreating tax revenues that have decelerated 22.4 percentage points from last year.

However, non-tax revenue surged 52.8 percent in the first four months this year, becoming a main driver of the fiscal revenue increments.

A total of 188.9 billion yuan ($29.87 billion) more of non-tax revenues were collected in the first four months in 2012 compared with last year, which accounted for more than 40 percent of the fiscal income growth.

?Tax and fiscal revenue have always been key factors in the assessment of local governments,? said Wang Yongjun, a researcher with the Central University of Finance and Economics.

?To maintain the fiscal income growth amid the economic slowdown and structural tax cuts, some local authorities will explore the potential in non-tax collections.?

South Korean court rules Samsung didn't copy iPhone

SEOUL, South Korea ? South Korea's Samsung won a home court ruling in its global smartphone battle against Apple on Friday when judges in Seoul said the company didn't copy the look and feel of the U.S. company's iPhone, and that Apple infringed on Samsung's wireless technology.

However, in a split decision on patents, the panel also said Samsung violated Apple technology behind the bounce-back feature when scrolling on touch screens, and ordered both sides to pay limited damages.

The Seoul Central District Court ruling called for a partial ban on sales of products including iPads and smartphones from both companies, though the verdict did not affect the latest-generation phones ? Apple's iPhone 4S or Samsung's Galaxy S3.

The ruling affects only the South Korean market, and is part of a larger, epic struggle over patents and innovation unfolding in nine countries. The biggest stakes are in the US, where Apple is suing Samsung for $2.5 billion over allegations it has created illegal knockoffs of iPhones and iPads.

The Seoul ruling was a rare victory for Samsung in its arguments that Apple has infringed on its wireless technology patents, which previously have been shot down by courts in Europe where judges have ruled that they are part of industry standards that must be licensed under fair terms to competitors.

"This is basically Samsung's victory on its home territory," said patent attorney Jeong Woo-sung. "Out of nine countries, Samsung got the ruling that it wanted for the first time in South Korea."

The ruling ordered Apple to remove the iPhone 3GS, iPhone 4, iPad 1 and iPad 2 from store shelves in South Korea, saying that the products infringed on two of Samsung's five disputed patents, including those for telecommunications technology.

The court also denied Apple's claim that Samsung had illegally copied its design, ruling that big rectangular screens in cases with rounded corners had existed in products before the iPhone and iPad.

"It is not possible to assert that these two designs are similar based only on the similarity of those features," the court said in a ruling issued in Korean that was translated into English by The Associated Press. It also said individual icons in the Samsung products do not appear similar to the icons Apple used in the iPhone.

But the court ruled that Suwon, South Korea-based Samsung had infringed on one of Apple's patents on the feature that causes a screen to bounce back when a user scrolls to an end image. The court banned sales of Samsung products using the technology, including the Galaxy S2, in South Korea.

Antarctic ice sheet quakes shed light on ice movement and earthquakes

ScienceDaily (Aug. 23, 2012) ? Analysis of small, repeating earthquakes in an Antarctic ice sheet may not only lead to an understanding of glacial movement, but may also shed light on stick slip earthquakes like those on the San Andreas fault or in Haiti, according to Penn State geoscientists.

"No one has ever seen anything with such regularity," said Lucas K. Zoet, recent Penn State Ph. D. recipient, now a postdoctoral fellow at Iowa State University. "An earthquake every 25 minutes for a year."

The researchers looked at seismic activity recorded during the Transantarctic Mountains Seismic Experiment from 2002 to 2003 on the David Glacier in Antarctica, coupled with data from the Global Seismic Network station Vanda. They found that the local earthquakes on the David Glacier, about 20,000 identified, were predominantly the same and occurred every 25 minutes give or take five minutes.

The researchers note in the current Nature Geoscience that, "The remarkable similarity of the waveforms ? indicates that they share the same source location and source mechanisms." They suggest that "the same subglacial asperity repeatedly ruptures in response to steady loading from the overlying ice, which is modulated by stress from the tide at the glacier front."

"Our leading idea is that part of the bedrock is poking through the ductile till layer beneath the glacier," said Zoet.

The researchers have determined that the asperity -- or hill -- is about a half mile in diameter.

The glacier, passing over the hill, creates a stick slip situation much like that on the San Andreas fault. The ice sticks on the hill and stress gradually builds until the energy behind the obstruction is high enough to move the ice forward. The ice moves in a step-by-step manner rather than smoothly.

But motion toward the sea is not the only thing acting on the ice streaming from David glacier. Like most glaciers near oceans, the edge of the ice floats out over the water and the floating ice is subject to the action of tides.

"When the tide comes in it pushes back on the ice, making the time between slips slightly longer," said Sridhar Anandakrishnan, professor of geoscience. "When the tide goes out, the time between slips decreases."

However, the researchers note that the tides are acting at the ground line, a long way from the location of the asperity and therefore the effects that shorten or lengthen the stick slip cycle are delayed.

"This was something we didn't expect to see," said Richard B. Alley, Evan Pugh Professor of Geosciences. "Seeing it is making us reevaluate the basics."

He also noted that these glacial earthquakes, besides helping glaciologists understand the way ice moves, can provide a simple model for the stick slip earthquakes that occur between landmasses.

"We have not completely explained how ice sheets flow unless we can reproduce this effect," said Alley. "We can use this as a probe and look into the physics so we better understand how glaciers move."

Before 2002, this area of the David glacier flowed smoothly, but then for nearly a year the 20-minute earthquake intervals occurred and then stopped. Something occurred at the base of the ice to start and then stop these earthquakes.

"The best idea we have is that during those 300 days, a dirty patch of ice was in contact with the mount, changing the way stress was transferred," said Zoet. "The glacier is experiencing earthquakes again, although at a different rate. It would be nice to study that."

Unfortunately, the seismographic instruments that were on the glacier in 2002 no longer exist, and information is coming from only one source at the moment.

U.S. CBO sees worse economic wreckage from "fiscal cliff"

WASHINGTON (Reuters) - Massive U.S. government spending cuts and tax hikes due next year will cause even worse economic damage than previously thought if Washington fails to come up with a solution, the Congressional Budget Office warned on Wednesday.

Without action by Congress to avoid a "fiscal cliff," Americans should expect a "significant recession" and the loss of some 2 million jobs, CBO director Doug Elmendorf said in his gloomiest assessment yet.

He said the economy is already being "held back" by the mere anticipation of the fiscal cliff and the uncertainty surrounding it, causing businesses to put off investment and hiring decisions.

"The sooner that uncertainty is eliminated, the better," Elmendorf told a news conference. "The stakes are very high in the fiscal policy decisions we're going to have to make very shortly."

The report from the nonpartisan agency should intensify pressure on Congress and the White House to resolve deep differences over cutting spending or extending tax cuts enacted during the George W. Bush administration.

But chances for a deal before the November 6 election are slim. They could improve during the post-election lame-duck session of Congress, but that's unpredictable as well.

Reactions to the report did not signal any signs of movement by Democrats or Republicans from entrenched partisan positions that form the basis of their campaigns.

"This is a challenging time for America and one thing I will do is I will finally cut federal spending, encourage growth and as a result of those two things get America to a balanced budget," Republican presidential hopeful Mitt Romney said on the campaign trail in Little Rock, Arkansas.

The CBO report, added Amanda Henneberg, a Romney campaign spokeswoman, is "another indictment of President Obama's economic policies that have resulted in overspending, increasing debt and a growing financial burden on the next generation."

White House Press Secretary Jay Carney batted the blame back to Republicans in Congress.

"They're willing to hold the middle class hostage unless we also give massive new tax cuts to millionaires and billionaires -- tax cuts we can't afford that would do nothing to strengthen the economy," Carney said in a statement.

WORST FISCAL TIGHTENING SINCE VIETNAM

The "fiscal cliff" refers to the impact of around $500 billion in expiring tax cuts and automatic spending reductions set for 2013 as a result of successive failures by Congress to agree on some orderly alternative method of reducing budget deficits.

Failure to avoid it would spark U.S. fiscal tightening on a scale not seen since the 1969 tax increases to pay for the Vietnam War -- slamming the economy into recession as it did back then.

The CBO estimated that U.S. gross domestic product under this scenario would shrink 0.5 percent in 2013, with a crushing first-half contraction of 2.9 percent followed by a weak second-half rebound of 1.9 percent growth.

In a May estimate of fiscal cliff effects, the CBO had forecast full-year 2013 GDP growth of 0.5 percent, with a 1.3 percent first-half contraction and second-half growth of 2.3 percent.

The main reasons for the gloomier outlook now are a weaker global economy, the growing uncertainty mentioned by Elmendorf about what Congress will do, and a determination that the cliff is somewhat steeper than previously thought.

The May estimate did not include the effect of expiring payroll tax cuts and the end of extended unemployment benefits. Factoring in the end of those streams of cash to Americans would increase the shock to aggregate demand.

WEAK GROWTH UNDER EXTENSION

Were Congress to extend all current tax policies and simply halt the automatic spending cuts, as many Republicans have proposed, the CBO said the economy would continue to grow, albeit weakly.

GDP growth under this more optimistic scenario would be modest in 2013 at 1.7 percent, with an 8.0 percent unemployment rate compared with 9.1 percent should the U.S. go over the fiscal cliff.

But it would cause the deficit to remain above $1 trillion for a fifth consecutive year, versus a sharp fall to $641 billion under the fiscal cliff scenario. Elmendorf said keeping deficits this high would greatly increase the chances of a U.S. debt crisis that spikes interest rates higher, dramatically raising all borrowing costs.

The current fiscal year, which ends on September 30, is on track to produce a $1.128 trillion deficit, CBO said -- a slight reduction from its most recent estimate of $1.171 trillion.

Part of this reduction was due to lower spending on the federal health programs Medicare and Medicaid.

Helen Fessenden, an analyst with Eurasia Group, which tracks political risks for investors, noted that the CBO report showed some slightly better-than-expected revenue estimates, which could buy the U.S. Treasury a bit more time before the $16.4 trillion U.S. debt ceiling needs to be raised.

Currently, the Treasury expects to reach that limit around the end of the year, but can take extraordinary measures to stretch its borrowing capacity into early 2013.

The next major development on the fiscal cliff is a report due from the White House on September 6 that details programs where the Obama administration plans to concentrate the automatic spending cuts should they occur. Half of the $109 billion in cuts for 2013 will be borne by the military and half by domestic programs.

Michael Jackson's nephew made co-guardian

LOS ANGELES ??A judge on Wednesday finalized an arrangement for Michael Jackson's nephew to serve as co-guardian of the late pop star's three children along with the kids' grandmother, who until recently had been solely responsible for their care.

The decision by Los Angeles Superior Court Judge Mitchell Beckloff follows recent turmoil inside the famous family over the pop star's estate after grandmother Katherine Jackson was reported missing. She later turned up in Arizona with her eldest daughter and other family members.

But due to her absence from her Los Angeles home, T.J. Jackson, 34, the nephew of the "Thriller" singer, was made temporary co-guardian of Prince, 15, Paris, 14, and Blanket, 10. Beckloff's ruling on Wednesday formalized his position while Katherine Jackson, 82, remains primary guardian.

"It's clear to me the children have a very strong, loving relationship with T.J. Jackson," Beckloff said.

Katherine Jackson's absence last month coincided with a letter sent by several Jackson siblings, including Janet, Randy and Rebbie, to the administrators of the pop star's estate challenging the validity of Jackson's will.

The will placed Jackson's estate under the administration of Los Angeles music executive John McClain and attorney John Branca, and it named Katherine Jackson and the pop star's three children as beneficiaries.

The estate, which includes rights to music and merchandise, generates millions in revenue annually and the administrators each receive lucrative fees for their work.

The dispute and Katherine's absence raised questions about her competence, and there were even accusations she may have been kidnapped by her adult children.

But Wednesday, Katherine Jackson's attorney, Sandra Ribera, reaffirmed that the grandmother is in control and approved of the decision to have T.J. Jackson act as co-guardian.

"Mrs. Jackson is a well-informed, strong woman who makes her own decisions and can't be influenced by anyone when it comes to these children," she said.

In a sworn declaration submitted to the court earlier this month, Katherine Jackson said she did not know her grandchildren were trying to reach her while she was away for about 10 days at a spa in Tucson, Ariz.
